This Privacy Policy for the www.redlodgemountain.com website, operated by Red Lodge Grizzly Peak Inc. (“Red Lodge Mountain”), describes the privacy practices for Red Lodge Mountain, Red Lodge Mountain Golf Course, Red Lodge Mountain Weddings, and Grizzly Peak Outdoors (the “Privacy Policy”). The purpose of this Privacy Policy is to inform you about: (i) the types of information we gather about you, including information gathered when you visit the Red Lodge Mountain (RLM) website located at www.redlodgemountain.com or RLM’s mobile site (collectively, the “Site”), and information we may receive from third parties or affiliates, (ii) how we may use that information, (iii) whether we disclose that information to anyone, and (iv) the choices you have regarding our use of, and your ability to correct, the information.

Red Lodge Mountain strives to help visitors of the Site protect their privacy while using our Site. By using the Site, you expressly consent to the use and disclosure of information as described in this Privacy Policy. This policy does not apply to other websites which are linked to any of the Site. Please also be aware that websites not controlled or authorized by RLM may have their own privacy and data collection policies and practices. We are not responsible for any actions or policies of such third parties. You should check the applicable privacy policies of those third parties when providing personally identifiable information to them.

 

How We Collect And Use Information

We collect information in several ways by your use of the Site, as well as from forms you submit to us, personal correspondence (such as emails or letters) that you send to us and/or your interaction with us at our establishments. We may ask you to voluntarily provide us with personal information on this Site. When you conduct searches on the Site, we may log the search terms that you use. Red Lodge Mountain collects this information in order to provide information about our products and services that will meet the expectations of our guests. Also, our third-party service providers may ask you voluntarily to provide personal information on their websites and may share such personal information with us, as governed by their respective privacy policies. Our use of information received from a service provider will be dictated by the service provider’s privacy policies and not this Privacy Policy.

We collect two types of Personal Information: Personally Identifiable Information and Non-Personally Identifiable Information. Personally Identifiable Information is information that identifies you or can be used to identify or contact you (“Personally Identifiable Information”). We also may collect information that by itself typically cannot be used to identify or contact you, such as demographic information (e.g. your age, profession or gender), user IP addresses, browser types, domain names, and other anonymous statistical data involving the use of our Site (“Non-Personally Identifiable Information”).

Personally Identifiable Information we collect from you may include your name, email addresses, telephone and fax numbers, credit card information, date of birth, photograph image, social media information, lifestyle information such as names and ages of children, and other information either desirable or necessary to provide quality services to our visitors (e.g., health conditions that require special accommodations). We may also collect information about you, such as your use of our Site, travel habits, communication preferences, and aggregated data relative to your visits to Red Lodge Mountain. If you are a parent registering your child for lessons or other services provided by RLM, we may collect information concerning your child’s medical needs or health.

Red Lodge Mountain may collect information about you so that we can provide an experience that is responsive to our guests’ and visitors’ needs. We may collect information as part of: (i) fulfilling information requests, (ii) purchasing products or services, including tickets, (iii) applying or registering for season passes, (iv) engaging in social networking; (v) engaging in various activities at our resort, (vi) submitting a job application, or (vii) responding to communications from us (e.g., surveys, promotional offers, contests or sweepstakes, or reservation confirmations). We endeavor to collect information only with your knowledge or (based upon this Privacy Policy) your expectation and with your permission if necessary.

To the extent we are able to do so, we may link your Non-Personally Identifiable Information with your Personally Identifiable Information. We may link information collected online, with information we collect offline or information collected online by third parties, such as social networking sites, or other online services. Our use of any information received from third parties is governed by such third parties’ privacy policies, and not by this Privacy Policy.

COOKIES

Like many other websites, the Site may use cookies to customize content specific to your interests and track your use of the Site. “Cookies” are text files that are stored on your computer and may be used to store your personal information. For example, we use “cookies” to (i) customize content specific to your interests, (ii) ensure that you do not see the same advertisement repeatedly. In addition to cookies, Red Lodge Mountain may use other now known or later developed technologies to assist RLM in observing the behavior of users visiting the Site. These technologies access individual user information but the information is used only to compile aggregated statistics about the Site’s usage.

A “pixel tag” is a clear (transparent) image placed on a web page to collect information about the page view. This Site may use pixel tags to aggregate web traffic information, such as the number of unique visitors, the top paths through the site, entry pages and exit pages. Red Lodge Mountain does not use pixel tags to collect any personal information such as your name, age, phone number, address or e-mail address from Site visitors, and we do not maintain a database of individual browsing profiles.

WEBSITE ANALYTICS

This Site uses Google Analytics (and in the future may use other similar sites or services) to better assist Red Lodge Mountain in understanding how the Site is used. The analytics service will place cookies on your computer that will generate information that we select about your use of the Site. That information will be transmitted to and stored by the analytics service. The information will be used for the purpose of evaluating consumer use of the Site, compiling reports on Site activity for RLM’s use, and providing other services relating to Site activity and usage. The analytics service may also transfer this information to third parties where required to do so by law, or where such third parties process the information on the analytics service’s behalf. You may refuse the use of cookies by selecting the appropriate settings on your browser. Please note that by doing so, you may not be able to use the full functionality of the Site.

We may use technology that provides us with information about your geographic location (“Location Information”). For example, we may scan or collect information regarding your ski pass when you ride a chairlift at our resort. This information helps us monitor ski resort activity and provide better service to you. We also may combine Location Information with other information you provide to us online or with information collected offline. We will use Location Information collected and/or combined in that manner in accordance with this Privacy Policy.

We will use the information we collect from you to provide goods or services which you have requested or purchased from us, including providing you with notifications related to your activity on the Site or your use of any of the services offered on the Site (the “Services”). We may also use your Personal Information to send you targeted communications, and to notify you about news, events, special offers and promotions. Red Lodge Mountain may also use third-party service providers to send and distribute e-mail and to perform other marketing and product support functions. You can opt-out of receiving marketing and promotional e-mails from Red Lodge Mountain at any time by selecting the opt-out link included in the e-mail or by sending an email to [email protected] with “UNSUBSCRIBE” in the subject line.

 

Personal Information we may collect about you

Red Lodge Mountain (Red Lodge Grizzly Peak Inc.) collects Personal Information during the course of operating our mountain resort, golf course, weddings, and retail store. We use this information to provide you with the best possible service and to meet our reasonable business needs.

We Collect Your Personal Information When You Purchase a Product or Service, Make a Reservation, or Enroll in a Program.

When you make a purchase, we collect Personal Information in order to process the transaction and administer the purchase or program. We may also send you information relating to your purchase, reservation or program. For example, if you purchase lift tickets or passes, we may send you information about the activities, events or offers taking place at the resort around the time of your visit.
The information we may collect and use for these purposes includes but is not limited to your:

      • name and contact information to identify and communicate with you
      • payment card information to process transactions
      • age and/or birth date to ensure appropriate product pricing and know more about who is enjoying our products and services
      • gender to verify your identity, provide appropriate services, such as rental equipment, and know more about who is enjoying our products and services
      • bio-metric data when this information is necessary in connection with the product, service, program or activity that you have requested (for example, we may need gender, height and weight to provide you with appropriate rental equipment)
      • medical information, such as allergies or medical conditions that we need to be aware if you are participating in lessons or other programs, or if you have dietary restrictions
      • facial photograph to identify you as a guest
      • status as the parent or guardian of a minor guest, if applicable
      • transaction history to manage your purchases and reservations and to learn more about how you interact with our products

In some cases, you may provide us with Personal Information relating to a family member or another individual. By providing us with Personal Information relating to an individual other than yourself, you represent that you have their consent to provide us with their Personal Information for the purposes described in this Privacy Policy.

We Collect Your Personal Information When You Visit Our Resort & Establishments or Use Our Pass Products and Tickets

When you purchase or use our pass products and tickets, we may collect information regarding your geographic location, activities and purchases while you are at the resort, the golf course, or the retail shop. Our pass products and tickets use a handheld scanner technology. Through the use of this technology, we may be able to collect limited information regarding your location at the resort, including the lifts that you ride and, depending on whether you have a payment card linked to your pass product, other commercial transactions that you complete at one of our retail, rental, lesson, or restaurant locations. We use this information to understand how our guests use our establishments and to understand your personal preferences.

Depending on your marketing preferences, we may also use your Personal Information to send you offers, invitations or promotions relating to our resort’s products, services or programs that we believe may be of interest to you. For example, we may monitor your commercial transactions which may influence the personalized special offers and promotions that we send to you.

Some of our pass products grant you access to ski resorts and golf courses that are not owned or operated by Red Lodge Grizzly Peak Inc. (each a “Pass Partner Resort”). When you visit a Pass Partner Resort, the Pass Partner Resort will scan or otherwise record your attendance at that resort destination which allows the Pass Partner Resort and us to record your usage activity of the product. When you transact directly with a Pass Partner Resort, that resort’s privacy policy will apply. For example, if you book lodging accommodations or a ski school lesson directly with a Pass Partner Resort, that resort’s privacy policy will apply to that transaction.

At certain locations of our resort, golf course, or retail shop, we may use video surveillance for the safety and security of our guests, employees and property. We will retain video recordings for as long as reasonably necessary for these purposes.

Our mountain resort and golf course use live stream webcams in outdoor public areas both on mountain and at the golf course. These live web cam feeds can be accessed by anyone via an internet connection.

We Collect Your Personal Information When You Submit an Inquiry, Complete a Guest Survey, or Provide Feedback

We may collect your name, contact information, comments or questions, and/or other Personal Information when you submit an inquiry or comment or otherwise provide us with feedback about our business. Through a guest satisfaction survey we may also collect information related to your experience at our establishments or from your usage of our products and services.. These surveys may include optional questions regarding your income, race/ethnicity, and gender which, if answered, help us to learn more about our customers and how we can improve our business and public engagement in snow sports. We may use this information to respond to your question and to improve our business, products, services and programs.

We Collect Your Personal Information When You Participate in a Marketing Initiative or Create an Online Account

We may also collect your name, contact information, age and/or date of birth if you decide to participate in a marketing initiative such as a contest, sweepstakes or other promotion. In some cases, we may also ask you specific questions about your preferences or for feedback on our business, products, services and programs. We use this information to (i) administer the promotion, including contacting and announcing winners (where applicable), (ii) to improve our business, products, services and programs, and (iii) for marketing initiatives, such as offers or promotions relating to our resort, products, services, or programs that we believe may be of interest to you, depending on your marketing preferences.

We Collect Your Personal Information From Third Parties

If you are a resident of the U.S., we may also supplement the Personal Information that you provide to us with information that we obtain from third parties (e.g. Liftopia, Snowledge etc.).

 

Sharing personal information collected on our websites

From time to time we may partner with other companies to provide co-sponsored or co-branded promotions, products and services, and we may share your information with our co-sponsor. For example, we may co-sponsor some sweepstakes or contests on our Site with other companies, or we may provide prizes for sweepstakes and contests sponsored by other companies. If you enter one of these sweepstakes or contests, we may share your Personal Information with our co-sponsor or the third-party sponsor. When you use a credit card to purchase goods or services, we may share your information with the credit card company and other companies involved in the authorization process. Use of shared information is subject to third parties’ policies.

We Will Never Sell Your Personal Information.

We rely on service providers to help us deliver products and services, such as offering products and services, providing services in connection with our websites including travel packages, communicating news and delivering promotional materials via email and direct mail, processing credit card transactions, and administering sweepstakes and surveys. Red Lodge Mountain may provide your Personal Information to service providers or contractors to perform functions on its behalf, including, but not limited to, companies or individuals hired to: (i) communicate news, (ii) deliver RLM’s promotional materials via e-mail and direct mail, (iii) develop, enhance, market or provide any of RLM’s services,  (iv) process payments and (v) assist RLM with sending communications and performing other marketing and support functions.
During the course of our business we may also share with third parties aggregated demographic and statistical information that is not personally identifiable.

Red Lodge Mountain may also disclose an individual’s Personal Information to:

    1. a person who in the reasonable judgment of Red Lodge Mountain is seeking the information as an agent of the individual.
    2.  a company or individual employed by Red Lodge Mountain to perform functions on its behalf, such as but not limited to research or data processing.
    3.  another company or individual for the development, enhancement, marketing or provision of any of Red Lodge Mountain’s products and services.
    4. a public authority or agent of a public authority, if in the reasonable judgment of Red Lodge Mountain, it appears that there is imminent danger to life or property which could be avoided or minimized by disclosure of the information.
    5. another entity as part of a merger, a sale of assets or all or part of a business, or any other corporate change or re-organization.
    6. a third party or parties, where the individual consents to such disclosure or disclosure is required or permitted by law.

Red Lodge Mountain may also be required to use or disclose your information in connection with a legal action or other proceeding, without limitation, in response to a court order or a subpoena. This includes any actions that may be brought by Red Lodge Mountain against you as a result of your failure to meet your obligations under any agreements you may have with us including the Terms of Use and any reservation agreements.

 

How We Store Your Information

Red Lodge Mountain is committed to protecting the security of any Personal Information you provide. After you have submitted any information online to Red Lodge Mountain, we recommend that you end your browser session before leaving your computer. In spite of these protections, any information submitted over the Internet could be intercepted or otherwise corrupted during transmission. As such, Red Lodge Mountain cannot guarantee the security of any data submitted over the internet. After your information reaches Red Lodge Mountain, however, it is stored on servers (or, in the case of information received from you in person or over the phone, in physical storage areas) protected by procedures and technology designed to block reasonably foreseeable intrusions by unauthorized third parties. The servers are under the control of Red Lodge Mountain at all times but may be hosted, managed or otherwise maintained by third party service providers. These third-party service providers have no right to use or access this data other than at the direct request (or on behalf of) of Red Lodge Mountain.

 

Third Party Links

The Site may list or link to third-party pages, products or services. Red Lodge Mountain does not have any control over the quality, safety, or accuracy of the of third-party pages. Red Lodge Mountain will not be a party to any transactions between you and such third parties, and any correspondence concerning such transactions should be conducted between you and the third party.

 

MINORS

Red Lodge Mountain does not seek to obtain nor does it wish to receive Personally Identifiable Information directly from minors; however, we cannot always determine the age of persons who access and use the Site. If a minor (as defined by applicable law) provides us with his/her data without parental or guardian consent, we encourage the parent or guardian to contact us to have this information removed and to unsubscribe the minor from future Red Lodge Mountain marketing communications. If Red Lodge Mountain learns that, despite these measures, a minor has submitted Personally Identifiable Information to Red Lodge Mountain through the Site, it will take reasonable measures to delete such information from its records and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required by law).

The Site is a U.S. site and is governed by U.S. law. However, there are certain exceptions to the law, when it is necessary to maintain Personal Information in order to do any of the following:

Complete the transaction for which the Personal Information was collected; provide a good or service requested by the consumer; perform actions reasonably anticipated within the context of a business’s ongoing business relationship with the consumer, or otherwise perform a contract between the business and the consumer.
  2. Detect security incidents, protect against malicious deceptive, fraudulent, or illegal activity, or prosecute those responsible for that activity.
  3. Debug to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure another consumers right to exercise free speech, or exercise another right provided for by law.

Right to Opt-Out of Sale

Red Lodge Mountain will never sell your Personal Information.
Per the CCPA, you have a right to opt-out of the sale of your Personal Information. For consumers under 16, businesses cannot sell your Personal Information unless you have specifically opted-in to the sale. For consumers under the age of 13, a parent or guardian must opt-in on behalf of the child.

 

Right to Non-Discrimination

Red Lodge Mountain will not discriminate against you for exercising any of your rights under the California Consumer Privacy Act.

 

Policy Changes

Red Lodge Mountain may amend this Privacy Policy from time to time in order to meet changes in the regulatory environment, business needs, or to satisfy the needs of our guests, properties, strategic marketing partners, and service providers. Updated versions will be posted to our website and date stamped so that you are always aware of when the Privacy Policy was last updated. As we may make changes from time to time without notifying you, we suggest that you periodically consult this Privacy Policy.
